Client - any person who subscribes to, buys or uses our services. 

Personalised data - information that no longer relates to a natural person, as all the elements allowing the identification of the person have been removed from the personal data set.

Services - any products and/or services offered by us, whether electronic or non-electronic.

Data Subject - means the natural person from whom retroprint.lt receives and processes personal data.

Submission of data - disclosure of personal data by transmission or otherwise making them available (except publication in the media).

Automatic data processing - processing operations carried out wholly or partly by automated means.

Consent - a voluntary indication of the data subject's willingness to have his or her personal data processed for a purpose known to him or her. Consent to the processing of special categories of personal data must be given explicitly, in writing, in equivalent form or in any other form which unambiguously demonstrates the data subject's wishes. 

Direct marketing - activities designed to offer goods or services to persons by post, telephone or other direct means and/or to seek their opinion on the goods or services offered.

Data Processor - a legal or natural person (other than an employee of the controller) authorised by the controller to process personal data. The processor and/or the procedure for appointing the processor may be laid down in laws or regulations.

Third party/party - a legal or natural person, other than the data subject, the controller, the processor and persons directly authorised by the controller or processor to process the data.

This privacy policy applies to retroprint.lt. In the course of providing our services and as described in more detail below, we may collect personal information about a visitor to our website.

Electronic or other copies of this Privacy Policy shall be deemed to be a true, valid, complete, authentic and enforceable copy of this Privacy Policy as in effect on the respective date on which you visited our website.

4. What data do we collect?

  • Information you provide voluntarily: when you register on our website directly or through third-party services (Facebook, Google, etc.), send us an email, contact us through third-party applications (Facebook, Instagram, etc.)), consult our staff in writing, orally or by any other means regarding the products and/or services we sell, subscribe to our newsletter service, use the comment function on our website, contact us in any other way and voluntarily provide information about yourself. This may include your name, surname, nickname, physical address, email address, telephone number, bank transfer information. As well as details such as gender, age, job title, place of residence, purchase history and other demographic information.
  • Information that we collect automatically: when you use our services, browse our website, we collect information about the pages visited on the website and other browsing, activity history and statistics. This may include your IP address, device operating system, browser ID, browsing activity and other information relating to your activity on the website or other services we provide. We collect some of this information from log files, as well as through cookies and other tracking technologies.   • Information we receive when you use our services: When you place an order on the website, you provide your name, surname, telephone number, registration address and delivery address, bank transfer information, details such as gender, age and other information disclosed by you. Also, when you register on our website, you provide your email address, name, and date of birth, which we need to verify that you are at least 14 years old and eligible under the laws of the Republic of Lithuania to be a registered member of our community. 
  • Cookies: we and our partners use various technologies to collect information about website usage statistics and browsing activity, which may include technologies such as cookies or similar technologies such as pixels or web beacons to analyse trends on the website, administer the website, and to provide statistics on personalised demographic information about website visitors, and we are not able to identify a specific person by the information we receive. Each visitor can control and refuse how the browser accepts or does not accept any cookie in their web browser. We use our own cookies on our website together with third party cookies to ensure the full functionality of the website and for marketing purposes to show you specialised offers for you on other platforms (Google, Facebook, Instagram). 

5. Where do we use your data?

  • For the execution of a sales contract with you: after making an order or using the services provided.
  • For sending system emails: emails relating to your order, changes to the privacy policy, information relating to the operation of the website, system emails relating to your user account, updates and other non-advertising information.
  • To communicate with you about your account, orders and provide customer service.
  • To protect your rights and privacy and the rights and privacy of us and third parties.
  • To bring, exercise or defend legal claims: to a court, bailiffs or other authorities to whom we are obliged to transfer data in accordance with the lawful laws of the Republic of Lithuania.
  • Provide you with automated, tailored offers based on your interests, products viewed and browsing history.
  • For direct marketing purposes: if you voluntarily provide your email address by subscribing to our newsletter, we add you to our database and send you special offers, promotions, news and other information we consider useful several times a month to the email address provided. Also, if we have your email address in our database, if you are a registered user or you entered it when you placed your order but did not complete it, we will send you a one-off reminder about your abandoned basket. Through the use of cookies, we may also collect information in order to provide browser-specific advertising or content by creating different target groups. 
  • For the supply of third-party services: to deliver the goods you have ordered, we use third-party services according to your choice of delivery method, so we provide the delivery data you provide, such as name, delivery address, telephone number, to the relevant company, which uses your data in accordance with their privacy policy. When you subscribe to our newsletter, your email is forwarded to the newsletter service provider. Your banking information, money orders and other billing information and is transmitted via a third party service, unless you make the transfer yourself by logging into your bank. You can read the privacy policy of each company to which we transfer certain of your personal data on their website.

6. How long do we keep your data? 

We process your Personal Data collected for direct marketing purposes for 2 (two) years, except in cases where longer retention of the data is required by the legislation in force in the Republic of Lithuania. When the Personal Data is no longer required for the purposes of its processing, it shall be destroyed, except for the Personal Data that must be handed over to public archives in the cases provided for by law.

7. Your rights:

  • know what data is collected about you: Upon a request from an individual to provide what data we have collected about him or her, we will do so within 30 calendar days from the date of the request. Every person has the right to know what information we have collected, to request its correction or deletion. If, following a request, we have any suspicions as to the identity or age of the applicant, we have the right to ask for the applicant's identity document or a copy thereof. 
  • opt-out of having your information used for direct marketing purposes: we do not oblige our customers to receive newsletters or any other promotional information sent to them, so you can unsubscribe from this service freely by logging in to your profile or by clicking on the interactive link at the bottom of every promotional email you receive.
  • being forgotten: Unless otherwise provided by the Regulation or the legislation of the Republic of Lithuania, we will, at your lawful request, delete all the data we have collected about you from our servers and information system within 4 calendar days, unless this would be impossible or would require disproportionate effort on the part of the Data Controllers. Data may not be erased if its retention is required by European Union or national legislation. 
  • disagree: you may not agree with our privacy policy, however, due to the fact that we need certain data from you for the performance of the contract and to ensure the smooth operation of the website, we need your data, so if you do not agree with our rules, we unfortunately cannot enter into a contract of sale with you and provide you with the services we offer.

8. Public information and third-party websites/apps

  • Blog and comments on retroprint.lt. We have a publicly accessible blog and comment sections where the information and personal data you provide can be read and collected by anyone. If your personal information has been submitted on our website and you wish to delete it, please contact us at the contact details provided in this Privacy Policy or on this website. If we are unable to remove it, we will let you know why we are unable to do so.
  • Social networking platforms and related apps. Our website integrates the functions of services provided by third parties (Facebook, Instagram, Google, etc.), so if you use Facebook or other third-party logins, they may collect information about you and place a cookie on your browser to ensure the proper functioning of their services. Also, we operate on various social networks, so when you interact with us or send information using any platform, you do so at your own risk without expectation of privacy. We cannot control the actions of other users of these platforms or the platforms themselves. When you use third party platforms, you are subject to the privacy policies of those companies. 
  • Links to third-party platforms. Our website may contain links to other websites whose privacy policies may differ from ours, so when you provide any information or visit another website, we recommend that you read those companies' privacy policies carefully. 

9. Competitions, games and surveys

We may from time to time run competitions, games, surveys or other promotions on our website or through social media (collectively, "competitions"). Participation in our competitions is entirely voluntary. We may ask you for personal information such as your name, address, date of birth, telephone number, email address, nickname or other details. We use this information to administer the competition. We may also, except where prohibited by the rules of the competition or by law, use the information you provide to communicate with you or people you nominate about the services we provide. We may share this information with our affiliates or other service providers subject to the terms of this Privacy Policy. 

10. Email content

Email is sent between certain servers as it travels over the internet to the recipient. Along the way, administrators on the servers can see and read your messages. Email is not a confidential communication channel, so we recommend that you do not send confidential information via email.

We may disclose information about you to our employees, managers, agents, suppliers or subcontractors as reasonably necessary for those purposes as set out in this Privacy Policy. In addition, we may disclose information about you:

  • to assert our rights or interests (including the provision of your data to third parties for the purpose of collecting debts owed to us).

Except as provided in this Privacy Policy, we do not provide your personal data to any third parties.

12. Security of your personal data

Your personal data will be processed in accordance with the Regulation, the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal requirements. When processing your personal data, we implement organisational and technical measures to ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing. We retain your personal information for archiving purposes for a maximum period of 10 years or until we are required to comply with our legal obligations, resolve disputes and fulfil our commitments. This is also to prevent abuse and other unlawful activities.  

13. Responsibility

You are responsible for maintaining the confidentiality of your password and user data and for any actions (transmission of data, orders placed, etc.) that are performed on our Website after logging in with your login data. You may not disclose your password to third parties. If a third party accesses the services provided on our Website using your login credentials, we will consider that you have logged in. If you lose your login credentials, you must notify us immediately by post, telephone, fax or email.

You are responsible for ensuring that the data you provide to us is accurate, correct and complete. If the data you have provided changes, you must inform us immediately by changing the relevant details on the registration form or, if the details are not included on the registration form, by informing us by e-mail. In no event shall we be liable for any damage caused to you as a result of your providing incorrect or incomplete personal data or your failing to inform us of any change in the personal data.

RULES AND ABUSES

14. Basic rules

To use the services provided by retroprint.lt, you must:

  • be at least fourteen (14) years old;
  • fill in a registration form, create an account using third-party services, use services as a "guest";
  • agree to the privacy and website use policy;
  • provide accurate, complete and up-to-date contact information.

By registering on our website or otherwise using our services, you acknowledge that you have read and agree to this Privacy Policy, and you also grant us the right to collect, store, systematize, use and process for the purposes set out in this Privacy Policy, all the personal data specified herein.

We do not allow accounts whose primary purpose is to promote and cause harm to others, to promote discrimination, hatred, or to distribute offensive content, and we reserve the right to suspend your membership of our website, terminate your account, or otherwise deny you access to our website. 

15. General provisions

These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the "Terms and Conditions") set out the general terms and conditions and the procedure for the use of the retroprint shop online at retroprint.lt (hereinafter referred to as the "Shop"). The Rules shall apply when the Customers select, order and purchase the goods offered by the Seller in the Shop or use the services provided by the Shop. The Shop is an online retail store aimed at consumers who purchase goods to meet their personal, family, household needs not related to business or profession.

Any person or guest registered to the Shop system (hereinafter referred to as the "Buyer") is entitled to make purchases in the Shop. By registering in the Shop and/or placing an order, the Buyer unconditionally confirms that he/she is entitled to make purchases in the Shop. The Buyer shall not be entitled to place an order in the retroprint.lt Shop if the Buyer is not familiar with the Terms and Conditions and/or does not agree to them. Once the Buyer has placed an order, the Buyer shall be deemed to have read and accepted the Terms and Conditions. Once the Buyer has placed an order, the Terms and Conditions shall become a contract of sale between the Buyer and the Seller and shall constitute a binding legal document for both parties.

The Seller has the right to unilaterally change, amend or supplement the Terms and Conditions. The Buyer shall be bound by the Terms and Conditions in force at the time of placing the order when shopping in the retroprint.lt Shop, and is therefore advised to familiarize himself with the Terms and Conditions at the time of each shopping trip.

The Seller shall have the right to limit the number of registered Buyers, taking into account the technical capabilities of the Shop system; without prior notice to the Buyer, restrict the Buyer's use of the services of the Shop, as well as cancel the Buyer's registration, if the Buyer has used the Shop in violation of these Terms and Conditions, or if the Buyer has attempted to, or attempts to, undermine the stability and/or security of the Shop or of the Seller's orders, operation and/or security of the Seller's business; or to temporarily or permanently suspend the Shop's operation without prior notice to the Buyer. In the event of force majeure (force majeure) circumstances, the Seller shall have the right to suspend performance of the contract until the occurrence of force majeure (force majeure) circumstances have ceased to exist, notifying the Buyer of the suspension of the order. If the Buyer is no longer interested in the subsequent performance of the Contract, then the Buyer shall have the right to withdraw from the Contract by notifying the Seller. In the event of the suspension of the Seller's activities, but the possibility of fulfilling confirmed orders, all rights and obligations under these Conditions or applicable law in relation to orders already fulfilled or in progress shall remain in force.

16. Orders, registration, login details

The following Buyer details must be provided in the Purchase Form:

  • your name;
  • email;
  • the address to which the goods will be delivered, unless the buyer collects the goods himself at the collection point of his choice;
  • a contact telephone number.

The Seller has the right to determine other data necessary for the delivery of the goods.

It is the Buyer's responsibility to ensure that the data provided in the registration form is correct and complete. If the data provided by the Buyer in the registration form changes, the Buyer must update the data immediately and at the latest before the next order of goods. The Seller shall not be liable for any incorrect personal data provided by the Buyer and shall not be liable for any damage caused to the Buyer or third parties as a result.

The Buyer undertakes to keep confidential and not to disclose to any third party his/her username and password (hereinafter referred to as "Login Data"). The Buyer shall be responsible for the preservation of his/her Login Credentials, as well as for any actions performed in the Shop after logging in with the Buyer's Login Credentials.

By registering, the Buyer grants the Seller the right to collect, store, use and process, for the purposes set out in the Terms and Conditions, all of the Buyer's personal data that the Buyer provides directly or indirectly by registering and visiting and using the Shop, and the Buyer also grants the Seller the right to transfer the Buyer's personal data to the Seller's partners who, together with the Seller, administer the Shop, carry out the delivery of the goods, or perform any other services related to the Shop.

The personal data provided by the Buyer will be processed in accordance with the requirements of the European Union legislation and the Law on Legal Protection of Personal Data of the Republic of Lithuania, as well as other legal acts of the Republic of Lithuania regulating the processing and protection of such data. When processing and storing the Buyer's personal data, the Seller will implement organisational and technical measures to ensure the protection of the personal data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing.

The processing of the Buyer's personal data for direct marketing purposes will only be carried out with the Buyer's written, electronic or verbal consent. The Buyer expresses his/her consent to the processing of his/her personal data for direct marketing purposes by completing the registration form and by ticking the appropriate boxes in the form.

The Seller shall ensure that the personal data provided by the Buyer will be used exclusively by the Seller and its partners with whom the Seller cooperates in the administration of the Shop, delivery of goods and other services related to the placement or execution of the Buyer's order. The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners mentioned above in this clause, or in the cases provided for by the legislation of the Republic of Lithuania, where it is mandatory to do so.

The Buyer's personal data will not be stored for longer than the stated purposes of processing the personal data. The retention periods for personal data provided by the Buyer, as well as for the Buyer's data for direct marketing purposes, are set out in the Seller's Personal Data Processing Rules. After the expiry of the period of processing of personal data, or if the need for the processing of personal data ceases to exist, such data shall be destroyed in accordance with the procedure and under the conditions set out in the legislation and in the Seller's Rules for Processing Personal Data.

17. Prices, discounts, payments and terms

In the shop, the goods are listed together with the standard unit price of the goods. The prices of the goods in the order placed in the Shop shall be quoted in euros including VAT. Discounts granted to the Buyer shall not apply if the goods are on sale or on sale.

The Buyer may pay for the selected goods using the payment methods indicated.

If you choose to pay for the Goods by bank transfer, the order shall be processed only after the Buyer has received payment for the Goods and their delivery, unless otherwise agreed between the Seller and the Buyer. Payment shall be deemed to have been made when the total amount due has been received and credited to the Seller's bank account.

If the Buyer fails to pay for the Goods within 5 (five) working days from the time of placing the order, the Seller shall have the right to cancel the Buyer's order without prior notice to the Buyer.

18. Guarantee of the quality of the goods and the period of fitness for use (validity)

The characteristics of all goods sold in the Shop are generally indicated in the description of each product. The manufacturers and/or importers of the goods shall be responsible for the information on the characteristics of the goods (their correctness) and the Seller shall be solely responsible for the proper presentation (transmission) of this information to the consumers, unless otherwise provided by law.

The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the Shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the display (monitor) used by the Buyer or other technical reasons, as well as taking into account the reasonably possible discrepancies in appearance. If the discrepancy in the colour, size or shape of the Goods is due to the actions of the Seller or third parties related to the Seller, then the Seller shall be liable for any possible discrepancy in the appearance of the Goods.

The Seller confirms that it is responsible for the sale of the goods ordered in the Shop and for the proper delivery of the purchased goods, the quality of the goods, the proper fulfilment of the return conditions and the exercise of the Seller's other statutory rights and obligations.

In the event that the Seller does not guarantee the quality of the goods for certain types of goods, the warranty provided for in the relevant legislation shall apply.

In cases where legislation imposes a certain shelf-life period for specific goods, the Seller undertakes to sell such goods to the Buyer in such a way that the Buyer has a realistic opportunity to use such goods before the expiry of the shelf-life period.

19. Delivery and collection of goods

Goods purchased in the Shop shall be delivered throughout the European Union by parcel services of the Buyer's choice, except where the Buyer collects the goods himself.

The time limit for delivery of the goods when the parcel is handed over to the parcel service depends on the performance of the parcel service, which is beyond the control of the Seller. Furthermore, the Seller does not guarantee that the goods will be delivered within the specified time limit in all cases, especially if the ordered goods are not in the Seller's warehouses, the Buyer has provided incorrect data that needed to be corrected, the delivery address is not located in the territory of the Republic of Lithuania, and for other factors. The Seller reserves the right to change the delivery charges at its sole discretion.

The Buyer shall be informed by e-mail and/or SMS when the order has been confirmed and started.

20. Cancellation, return and exchange of goods

Goods are exchanged or returned in accordance with the applicable laws of the Republic of Lithuania. The costs of returning goods of the correct quality shall be borne by the Buyer.

In order to return goods of poor quality or high quality, the Buyer must contact the Seller at [email protected] and provide a clear statement of the goods to be returned, together with his/her name and surname, address, telephone number, the date of purchase of the goods, the name and quantity of goods to be returned.

When returning goods to the Seller, the following conditions must be observed:

  • the returned product must be in its original packaging in good condition (this does not apply if you are returning a faulty product);
  • the goods must be in good condition and undamaged by the Buyer;
  • the product must be unused and in good condition (no damaged labels, no torn protective film, etc.) (this does not apply if you are returning a low-quality product);
  • the returned goods must be in the same condition as when received by the Buyer;
  • When returning an item, you must present the proof of purchase and a completed return form.

When withdrawing from the Contract (returning the Goods), the Buyer shall, without delay and at the latest within 14 (fourteen) days from the date of the notification of the return to the Seller, send or deliver the Goods to the Seller. The Goods shall be replaced or the money paid for them shall be refunded to the Buyer's account no later than 14 (fourteen) days from the date of return.

The Seller may not refund the Buyer until the goods have been returned to the Seller or the Buyer provides proof that the goods have been sent to the Seller. The Seller shall have the right not to accept the Buyer's return of the Goods if the Buyer does not comply with the return procedure set out in this Part of these Conditions.

The Buyer may send the returned goods by courier.

21. Communication

The Seller shall send and otherwise contact all notifications to the e-mail address or telephone number provided by the Buyer in the registration form. The Buyer shall send all questions and notifications to the email address [email protected] or call +370 60940563.

22. Reporting abuse

If you believe that someone is violating this Privacy Policy and the Terms of Use, please notify us immediately by email, telephone or other means of communication.

RESPONSIBILITY

23. Limitation of liability

To the fullest extent permitted by law, you are fully liable for any damages arising out of your use of our website and other services provided by us. We and our team will not be liable for any indirect or consequential damages. 

We and our team are not responsible for the conduct of any advertisers, linked sites or other members.

FINAL PROVISIONS

24. We operate in accordance with the laws of the Republic of Lithuania

These Rules shall be governed by the law of the Republic of Lithuania. The law of the Republic of Lithuania shall apply to relations arising out of these Rules. Any disagreements arising out of the implementation of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure laid down by the legislation of the Republic of Lithuania. 

Any disagreements arising from the application of these Rules shall be settled by negotiation. The Buyer shall have the possibility to resolve any disputes with the Shop electronically, without recourse to the courts. The Buyer shall contact the Seller in writing (by e-mail) and submit to the Seller a free-form complaint regarding the goods and/or the Shop or the Seller's performance. In his/her complaint, the Buyer must specify the specific product(s) or service provided by the Shop in respect of which he/she needs to make his/her complaint and state his/her claim. Upon receipt of the Buyer's claim, the Seller shall examine the claim within 14 (fourteen) days from the date of receipt of the claim and shall provide the Buyer with its response. If the Seller does not respond to the Buyer's claim or if the Buyer remains dissatisfied with the Seller's decision, the Buyer shall have the right to appeal to the State Consumer Rights Protection Office.
